Law Enforcement Protocols

Guidelines for Government & Law Enforcement Requests

Last updated: October 2026

This page describes the protocols HeartSync follows when receiving requests for user information from law enforcement and other government agencies. It is intended to help officials submit valid legal process efficiently while protecting the rights of our users.

Summary: We disclose user data only in response to valid legal process (subpoena, court order, or search warrant), honor preservation and emergency requests under 18 U.S.C. §§ 2702–2706, notify users unless legally prohibited, and respond to international requests through MLAT channels.

1. Our Commitment

HeartSync ("HeartSync") is committed to assisting law enforcement in legitimate criminal investigations while respecting the privacy and constitutional rights of our users. We disclose user data only when we receive valid legal process as required by the Electronic Communications Privacy Act (ECPA), 18 U.S.C. § 2701 et seq., and other applicable law. We review every request carefully, reject or narrow overbroad or defective requests, and reserve the right to challenge requests that conflict with applicable law or these protocols.

2. Required Legal Process

Different categories of data require different legal process under 18 U.S.C. § 2703: • **Subpoena (or court order):** Sufficient for basic subscriber information, such as name, email address, account creation date, and account status. • **Court order under § 2703(d):** Required for non-content records, such as logs of user activity and message metadata (sender, recipient, timestamps). • **Search warrant (probable cause):** Required for the contents of communications, including message content, photos, and quiz responses. Requests must be issued by an authority with jurisdiction over HeartSync and must be signed and dated by the issuing official. We may request additional documentation to verify authenticity.

3. Emergency Requests

Under 18 U.S.C. § 2702(b)(8) and (c)(4), we may voluntarily disclose information without a warrant or subpoena when we believe in good faith that an emergency involving danger of death or serious physical injury to any person requires disclosure without delay. Emergency requests must: • Be submitted in writing from an official law enforcement email address (.gov, .state, or similar official domains) • Explain the nature of the emergency and the specific danger to life or limb • Identify the information requested and how it would assist in preventing the emergency • Be signed by the requesting officer and include agency contact information and badge or commission number Emergency requests may be submitted to pipedreamsproductions215@gmail.com with the subject line "EMERGENCY REQUEST". We will not honor emergency requests concerning civil matters or routine investigations.

4. Data Preservation Requests

Pursuant to 18 U.S.C. § 2703(f), upon receipt of a valid written request from a governmental entity, we will take reasonable steps to preserve account records for 90 days while the entity obtains the required legal process. The preservation period may be extended for an additional 90 days upon renewed request. Preservation requests must: • Come from an official law enforcement email address or agency letterhead • Identify the account(s) at issue by email address or other available identifiers • State the requesting agency, a point of contact, and reference to a pending investigation Send preservation requests to pipedreamsproductions215@gmail.com with the subject line "PRESERVATION REQUEST — 18 U.S.C. § 2703(f)".

5. Data We Maintain

To assist agencies in tailoring legal process, we maintain the following categories of data: • **Basic subscriber information:** Display name, email address, date of birth provided at registration, and account creation date. • **Profile data:** Bio, interests, and compatibility quiz responses. • **Messages:** Content of messages exchanged between users, with sender, recipient, and timestamps. • **Report and moderation records:** User-submitted reports and enforcement actions taken. • **Limited location data:** Proximity distances between active users are computed in real time; we do not permanently store precise GPS coordinates (see our Privacy Policy). We do not maintain real-time location history, biometric data, or data from deleted accounts beyond the 30-day deletion window described in our Privacy Policy. For users under investigation involving minors, see our Child Safety Standards page for CSAE/CSAM reporting obligations.

6. How to Submit Legal Process

All requests must be submitted in writing and include: 1. The specific legal instrument (subpoena, court order, or search warrant), signed and issued by an authority with jurisdiction 2. The identity of the requesting agency and the assigned officer, including badge or commission number, official email address, and direct phone number 3. The specific account(s) at issue, identified by email address or other available identifiers 4. A clear description of the categories of records sought and the relevant date range 5. Citations to the legal authority relied upon Requests may be submitted by email to pipedreamsproductions215@gmail.com (subject: "LEGAL PROCESS REQUEST") or by mail to our registered agent. Requests sent from personal or non-governmental email addresses will not be processed. We will confirm receipt within 5 business days and respond within the timelines permitted by law.

7. User Notice & Transparency

HeartSync's policy is to notify users of legal process seeking their data unless we are legally prohibited from doing so or notice would create a risk of danger to any person. If a gag order or other legal prohibition on notice applies, we will disclose user data only where the order is valid and appropriately scoped. We may also report aggregate statistics about the government requests we receive. Delayed-notice requests under 18 U.S.C. § 2705 will be honored for the period specified by law. We do not produce data in civil matters (for example, divorce or custody disputes, private litigation, or insurance investigations) except upon a valid court order issued in a civil proceeding that we have had the opportunity to review.

8. International Requests

Requests from law enforcement agencies outside the United States should be made pursuant to the applicable mutual legal assistance treaty (MLAT) or letters rogatory process through the U.S. Department of Justice. We will respond to properly executed requests received through these channels in accordance with U.S. law. Foreign legal process that has not been domesticated through the appropriate channel does not compel disclosure from HeartSync.

9. Fees

We may seek reimbursement for costs incurred in responding to legal process where permitted by law (e.g., 18 U.S.C. § 2706). Where a fee schedule applies, we will notify the requesting agency before incurring costs. We do not charge fees for emergency disclosures involving imminent danger to life.
